Asylum status is a form of protection available to individuals who meet the definition of a refugee, are in the United States, and/or are seeking admission at a port of entry.
– If you are eligible for asylum, you may be allowed to remain in the United States of America and in accordance with the United States Citizenship and Immigration Services.
– The asylum application submitted is also considered to be an application for withholding of removal. If asylum is not granted, you may still be eligible for withholding of removal.
“The Asylum Officer will determine if you are eligible for asylum by assessing whether you meet the definition of a refugee. The definition, which can be found in section 101(a)(42)(A) of the Immigration and Nationality Act (INA), states that a refugee is someone who is unable or unwilling to return and be taken advantage of. . “The protection of your country of nationality or, if you are stateless, country of last habitual residence due to persecution or a well-founded fear of persecution due to race, religion, nationality, membership in a particular social group or political opinion.”
